Civil Rights
CGM attorneys have been in the vanguard of pursuing claims for violations of civil rights. They have handled civil rights claims involving employment discrimination, hostile work environment, equal protection, due process violations and the like.
A client complained to CGM that after many years on the job, always with rave reviews for job performance, her relationship with her employer had taken a marked turn for the worse after she was out an extended time for medical reasons. During that time the employer hired a younger woman to "fill-in". When the client returned to the work, the younger woman was assigned to be the client's boss. Then the client received negative work reviews, was denied time off to see her doctors and, ultimately, fired for alleged poor performance. CGM attorneys filed suit claiming violation of the American with Disabilities Act and employment discrimination based on age. Proof was uncovered that showed circumstantially that the employer and supervisor schemed to create a false work record as a subterfuge to fire the client because of age. After this was brought to light, the case was quickly settled.
Civil rights violations are rarely evident on their face because such claims usually boil down to a question of intent which can be proved only by circumstantial evidence. CGM attorneys are adept at obtaining the evidence, recognizing the subtle inferences, and piecing together the true animus which spells out a civil rights violation.
