Construction Accidents & Labor Law

A CGM client was seriously injured when a make-shift scaffold he erected collapsed while he was painting a boat in his employer's shipyard. Who would think that a law governing construction of buildings applied to shipbuilding? The CGM attorneys successfully argued that the boat was a structure covered under a provision of New York's Labor Law which placed absolute liability upon owners of structures for accidents occurring because of insufficient scaffolding. Even though the injured worker was at fault for placing the scaffolding, a substantial recovery was obtained for the client because the Judge agreed that the Labor Law applied to the case.
